Upon registering with allex.ch, these terms and conditions as well as our price list apply to the contractual relationship between you and us, Allex Trading GmbH (Switzerland) as well as Allex GmbH (Germany). The version of these terms and conditions as well as the price list applicable at the time of the order shall apply. Allex Trading GmbH (Switzerland) and Allex GmbH (Germany) are hereinafter also referred to as ‘allex.ch’, ‘we’ or ‘us’.
The allex.ch terms and conditions as well as the price list apply to any use of an @allex.ch email or postal address.
Registration for allex.ch is not associated with any costs and is carried out by providing a private email address alongside a valid billing and shipping address in Switzerland, to which allex.ch will address deliveries. allex.ch may refuse registration without providing grounds. The use of a false identity is punishable in accordance with article 146 of the StGB and article 147 of the StGB.
For each order using the @allex.ch email address and stating the Allex GmbH (Germany) as the delivery address, you will be instructed by Allex GmbH (Germany) to purchase goods from German online shops and EU online retailers in its name and on its behalf:

allex.ch will be unable to process your order if the shipping or billing address differs. Additional info (such as ‘c/o’ or ‘FAO’) are not accepted. Insofar as the retailer requires a payment address for the credit card, please enter your own address here as the only exception. With the delivery of the order confirmation of the respective store to your e-mail address @allex.ch, the ownership of the order is transferred to Allex GmbH (Germany).
Allex Trading GmbH (Switzerland) obligates itself to sell the goods ordered from the German online shop or EU retailer to you at the same price as long as the goods were received by Allex GmbH in compliance with your order and there are no customs restrictions on the export from Germany or import into Switzerland. This may include but is not limited to goods that fall under non-customs regulations (NZE), such as ALL food and drink, animals and animal products, pet food, plants, salt, other agricultural products, precious metals, coins, banknotes, medications, alcohol (including wine and spirits), chemicals, fertilizer, fireworks, various cultural products, tobacco, narcotics and weapons, goods that violate intellectual property and other products. If allex.ch is not able to establish the final recipient of any order (e.g. if the allex.ch email address has not been used to forward your order confirmation) and research with the delivering online shop is fruitless, allex.ch shall store ordered goods for a maximum of two months. After this period, there is no longer any claim to the fulfillment of the purchase contract through Allex Trading GmbH (Switzerland) or Allex GmbH (Germany). allex.ch’s current price list applies to the order. Your payment made on behalf of allex.ch in the online shop (with the exception of any shipping costs) will be settled in full.
If ordering from retailers outside Germany but inside the EU that are not registered for German VAT. In this case, you will first pay the net price in the relevant shop and then a fixed sum outlined in the price list before delivery to Switzerland.

Regardless of the type, size, and weight of the goods, allex.ch shall deliver your order via Swiss Post to the shipping and billing address provided by you.
allex.ch accepts goods up to a weight of 30kg and dimensions of up to 100 x 60 x 60 cm or length 250 cm, circumference over 400 cm. For parcels exceeding the maximum values, please use our contact form to send a Special Order Request for your order.
We reserve the right to return parcels over these dimensions or weight to the sender if you didn’t contact us prior to shipment. All costs must be covered by you in any such case.
The service fees charged by allex.ch are to be paid before shipping from our warehouse to Allex GmbH (Germany) after goods have been received there. Please use your credit card for this payment. Allex GmbH (Germany) will inform you that your order has been received. As soon as receipt of your service fee has been confirmed, Allex GmbH (Germany) will approve your delivery and dispatch it to you. Goods delivered to allex.ch remain the property of allex.ch until payment has been received in full.
Insofar as a delivery has not been sent within two months after a notification has been sent confirming receipt of the delivery, allex.ch shall have the right to return these goods to the sender at the customer’s expense and/or to open the goods and sell the contents, to dispose of these or put them up for public auction. The customer will be informed of any auction, disposal and/or public sale two weeks in advance. Insofar as the notification cannot be provided to the customer as their contact address has changed but the customer has failed to inform allex.ch of this change or it cannot be provided for another reason within the customer’s sphere of influence, allex.ch shall have the right to dispose of the goods, sell the contents or put them up for public auction despite the customer not being notified. The proceeds will then be used to settle warehouse fees and expenses in accordance with the applicable price list. Insofar as there is a difference in favour of the customer, this sum shall be saved. Any warehouse costs and/or expenses of allex.ch shall be billed to the customer.
Ordered goods should only be paid for in the relevant online shop and only via the accepted credit cards, PayPal or instant transfer. We cannot accept goods delivered based on payment with other payment methods (e.g. invoice, payment on delivery, German bank transfer). The administration workload for returning such deliveries shall be billed in accordance with the price list.
Once your order is delivered to your address in Switzerland, allex.ch performance is considered completed in full.
The relevant conditions of the German online shop or other EU shop do not apply as the buyer’s contract is exclusively with Allex GmbH (Germany). allex.ch, however, does offer a service whereby deliveries or parts hereof are returned to the original sender in Germany or the EU insofar as the return is possible within the deadline. Please allow up to 7 days for processing.
For example, if there is a returns period of 14 days, allex.ch offers returns for products that are received by allex.ch no more than 7 days after the original order date. So, if a deadline is 30 days, allex.ch’s deadline shall be 23 days after the original order date.
allex.ch charges a fee for this service as outlined in the price list. There is no legal claim against allex.ch to a refund for the payment paid to the online shop. If such a refund is paid, it will be paid to Allex GmbH (Germany). Allex Trading GmbH (Switzerland) will then furnish the customer with a credit/refund invoice.
Only completely unused/unworn items are eligible for returns. Returns must be sent in their sealed original packaging. The use of product packaging as shipping packaging is not permitted. Please use outer packaging.
Independently returning goods to the original retailer, e.g. through sending to a postal address in Germany, is not permitted for customs reasons. By accepting the terms and conditions, the customer is agreeing to indemnify and hold harmless allex.ch in this regard.
The buyer must inspect the ordered item upon delivery and inform allex.ch of any damage within seven calendar days. Allex.ch shall not be held liable for any damage or reduction in value not within its sphere of responsibility. This liability is limited to the value of the purchased item.
Any guarantee claims are to be exercised directly against the original retailer on behalf of Allex GmbH (Germany) as the contractual partners. If it is necessary to return the item, allex.ch offers a return service in compliance with the price list within 24 months from the original order. This price list also applies to the delivery of replacements via allex.ch.
allex.ch does not pass personal data onto third parties in principle. The exchange of data within the scope of statutory regulations on insolvency, credit and customs issues are excepted.
allex.ch uses Google Analytics to facilitate an analysis of website use. This generates anonymous evaluations and graphs. Google Analytics only serves the purposes of internal market research and analysis.
allex.ch also uses cookies to save transactions and simplify future visits. You can control the use of cookies using the settings in your browser.
You expressly agree that allex.ch becomes aware of all content sent to you using your @allex.ch email address and the content of your sent messages. Allex.ch only uses this information to process orders.
Furthermore, allex.ch expressly does not accept liability for content, spam or phishing emails or malware distributed in this way by third parties to the email address provided by the customer via the allex.ch email address.
